PRIVACY POLICY NOTICE

By means of this privacy policy notice (hereinafter the “Notice”) and in accordance with the established in the article 16 of the Federal Law of Protection of Personal Information in Possession of the Individuals (hereinafter the “Law”), the Firm informs about the personal information it is receiving from the people interacting with the Firm and its professional team and the purposes for which they are destined, as well as the rights to which the owner of the personal information is entitled and the terms under which the treatment of their personal information within the Firm will be regulated.

The Firm, with domicile in Ave. Gomez Morin 955 South, Suite 500, Colonia Montebello, San Pedro Garza Garcia, Nuevo León, Zip Code 66279 will be responsible for the treatment of the personal information it receives.

According to paragraph V of article 3 of the Law, any information concerning an identified or identifiable individual is considered as personal information. For purposes of this Notice, personal information will be the information with respect to every person that the Firm receives by any printed, digital, electronic, optical, audible or visual means or through any other technology, and that concerns to such person (hereinafter the “Personal Information”).

The sending of the Personal Information to the Firm by any person through any of the means established in the previous paragraph implies the acceptance and authorization of such person to the way in which the Firm employs such Personal Information, which will be used in a general way and when necessary or convenient in the rendering of the legal services performed by the Firm from time to time in relation to the person sending them, as well as in relation with the subject matter that gave origin to the communication existing between the Firm and such person, and vice versa. The Personal Information will be used, including but not limiting to, the purposes of creating projects and/or final versions of legal documents, public deeds, memoranda and/or legal or commercial information, contracts, agreements, services proposals, communications in relation to the rendering of our services, collection, invoicing, remissions, accounting or fiscal information to which we are legally obliged, as well as in general, to communicate with our clients and send them information about our services, or any other type of procedure in relation with the rendering of the legal services offered by the Firm.

The Firm is obliged to:

  1. Limit the treatment of the Personal Information to the purposes set forth in the previous paragraph of this Notice;
  2. Maintain strict confidentiality of the Personal Information and to not transfer them to any person outside the Firm;
  3. Establish and maintain the administrative, technique and physical security measures that are necessary to protect the Personal Information against damage, loss, alteration, destruction or the unauthorized use, access or treatment, and
  4. Immediately inform of any security violation occurred during the treatment of the Personal Information in order for the persons who provided them to the Firm to be able to take the correspondent measures for the defense of their rights.

The owners of the Personal Information are entitled to accessing, rectifying, cancellation and opposition rights set forth in the Chapter II of the Law. For the exercise of any of these rights, the person in question must file an application to the Firm with the following information:

  1. His name and address or any other mean through which the Firm can communicate its answer;
  2. The documents that prove his identity or, in its case, the legal representation of the person filing the application on its behalf;
  3. The clear and accurate description of the Personal Information over which he wants to exercise any of the mentioned rights, and
  4. Any other element or document that facilitate the localization of his Personal Information.

In case of an application for rectification of Personal Information, in addition to the established in the previous paragraph, the person presenting the application must indicate the modifications to be performed, and provide the documentation that sustain his petition.

The application will be examined by the Administrative Manager of the Firm and must be sent by e-mail to .(JavaScript must be enabled to view this email address), or in writing to the Firm’s domicile indicated in the second paragraph of this Notice.

The Firm will have a period of maximum twenty business days, counting from the date in which the application is received, to notify the adopted decision, with the purpose of, if proceeding the application, becoming effective within the fifteen days following the date in which the decision is notified.

The terms of this Notice can change at any time, so the Firm reserves the right to modify it when it is considered necessary. The modifications to this Notice will be published in the Firm’s website, http://www.jatabogados.com, therefore it is the responsibility of the persons sending their information to be attentive of the website in order to be informed about the changes.
